These Terms and Conditions govern both your use of the Lakeside Services website and all services performed by Lakeside Services, LLC. Part One covers use of this website. Part Two covers the service work we perform, and is incorporated by reference into every quote, estimate, and work order we issue. Approving a quote confirms you have read and agree to Part Two and to any service-specific addendum that applies to your work. We may update these terms from time to time; the version in effect on the date your quote was issued governs that work.

Part One — Website Terms of Use

W1. Acceptance

By accessing or using lakesideservices.us, you agree to these Website Terms of Use. If you do not agree, please do not use the site.

W2. Permitted Use

This website is provided for informational purposes and for requesting estimates and services. You agree not to use the site for any unlawful purpose, to attempt to gain unauthorized access to any portion of it, to interfere with its operation, or to copy, scrape, or republish its contents for commercial use without our written permission.

W3. No Contract Formed by Use

Browsing this website, submitting a contact or estimate request form, or exchanging messages with us does not create a binding agreement for services. A service agreement is formed only when you approve a written quote issued by Lakeside Services, at which point Part Two of these terms applies.

W4. Accuracy of Information

We make reasonable efforts to keep site content current, but service descriptions, pricing references, availability, and imagery are provided for general information and are subject to change without notice. Any price or scope is binding only as stated in a written quote.

W5. Information You Submit

You agree that any information you provide through this website — including your name, address, contact details, and property information — is accurate and that you are authorized to provide it. You authorize us to contact you by phone, text message, or email regarding your request. Your information is handled in accordance with our Privacy Policy.

W6. Intellectual Property

All content on this website, including text, photographs, video, logos, and the Lakeside Services name and marks, is owned by Lakeside Services, LLC or used with permission, and may not be reproduced without written consent.

W8. Reviews and Testimonials

Customer reviews, ratings, and project photographs displayed on this site reflect individual experiences and are not a guarantee of any particular result.

W9. Disclaimer and Limitation for Site Use

This website is provided on an \"as is\" and \"as available\" basis without warranties of any kind. Lakeside Services is not liable for any damages arising from your use of, or inability to use, this website.

W10. Changes to These Terms

We may revise these Terms and Conditions at any time. Changes take effect when posted, and the \"last updated\" date above will reflect the revision.

W11. Governing Law and Contact

These Website Terms of Use are governed by the laws of the State of South Dakota. Questions about these terms may be directed to Lakeside Services, LLC using the contact information on this website.

Part Two — Service Terms and Conditions

The clauses below govern all landscaping, maintenance, and property services performed by Lakeside Services, LLC, and are incorporated by reference into every quote we issue.

Universal Core Clauses

These clauses apply to every Lakeside Services quote and contract, regardless of service type.

1. Quote Validity

This quote is valid for a period of 30 days from the date issued and pertains solely to the scope of work and materials outlined above. Any additional work not specified in this quote will require written approval and may result in additional charges prior to commencement. A quote requested after this 30 day period has expired may require updated pricing.

2. Payment Terms

A deposit is required to schedule larger projects, with the remaining balance due upon completion. Recurring services will be invoiced due upon receipt. Late payments may be subject to a service charge. Accounts more than 30 days past due may result in suspension of services until the balance is resolved.

3. Site Access and Utility Locates

For projects involving excavation or ground disturbance, Lakeside Services will request utility locates through Call Before You Dig. We cannot be held responsible for damage to unmarked or undisclosed private lines, including but not limited to irrigation systems, invisible fencing, drain tile, and low-voltage wiring. It is the client's responsibility to disclose the location of any such private lines prior to the start of work.

4. Delays and Conditions Beyond Our Control

Weather conditions, material delays, supplier availability, and site circumstances beyond our control may impact project timelines. Lakeside Services will not be liable for any delays resulting from these circumstances and will communicate updated timelines as soon as reasonably possible.

5. Warranty

Lakeside Services does not provide a workmanship warranty on installation projects. Ongoing performance and appearance can be maintained through a regular maintenance package, available separately. Service-specific warranty terms, where applicable, are outlined in the relevant service addendum below; where no such terms are stated, no additional warranty applies.

6. Liability

Lakeside Services' total liability for any project is limited to the total amount invoiced for that specific job. Lakeside Services is not liable for indirect, incidental, or consequential damages arising from the performance of services.

7. Cancellation

Clients may cancel a scheduled one-time service with at least 48 hours' written notice without penalty. Cancellations made with less notice may be subject to a trip or restocking charge. If Lakeside Services needs to cancel or reschedule a scheduled service, the client will be notified as soon as reasonably possible and the service will be rescheduled at no additional charge. Cancellation terms for recurring and seasonal contracts are outlined in the applicable service addendum.

8. Acceptance

By accepting this quote, whether by signature, deposit payment, or electronic approval, the client acknowledges and agrees to these terms and any applicable service-specific addendum below.

9. Permits and Approvals

Unless otherwise specified in writing, the client is responsible for obtaining any required permits, HOA approval, or other governing authorization prior to the start of work. Lakeside Services is not responsible for delays, fines, or corrective work resulting from a failure to secure required approvals.

10. Pre-Existing Site Conditions

Lakeside Services is not responsible for damage, delays, or additional costs arising from pre-existing site conditions not reasonably visible prior to the start of work, including but not limited to underground obstructions, poor drainage, unstable soil, or prior work performed by others. Any additional work required to address such conditions will be quoted separately and requires written approval before proceeding.

11. Photography and Marketing

Lakeside Services retains the right to photograph and document completed work for use in marketing, portfolio, and promotional materials, unless the client requests otherwise in writing prior to project completion.

12. Governing Law and Dispute Resolution

This agreement is governed by the laws of the state in which Lakeside Services is headquartered, regardless of the state in which the work is performed. In the event of a dispute, both parties agree to first attempt good-faith resolution directly before pursuing formal legal action.

13. Change Orders

Any change to the agreed scope of work must be documented in writing and priced before the additional work begins. Verbal requests for additional work will be confirmed in writing prior to scheduling or billing.

14. Force Majeure

Lakeside Services is not liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, labor shortages, supply chain disruptions, government action, or other events of force majeure, in addition to the weather-related delays described above.

15. Returned Payments

A fee may be charged for any payment returned unpaid by a bank or card issuer, including but not limited to bounced checks and declined or reversed card payments. Services may be paused until the balance and any associated fee are paid in full.

16. Termination

Either party may terminate an ongoing service relationship with written notice. Termination does not relieve the client of payment owed for work completed or services rendered prior to the termination date, including any deposit and material order obligations described above. Termination terms for seasonal or contract-based services are outlined in the applicable service addendum.

17. Confidentiality and Non-Solicitation

Pricing, proposals, and other business information provided by Lakeside Services are confidential and not to be shared with third parties. The client agrees not to directly solicit, hire, or engage any Lakeside Services employee or contractor outside of Lakeside Services during the service relationship and for one year after its conclusion.

18. Deposits and Material Orders

Deposits may be used to order materials specific to the client's project. Deposits are non-refundable once materials have been ordered or work has been scheduled based on the deposit. If a client cancels after material has been ordered, the client remains responsible for the cost of that material.

19. Documentation for Insurance and Liability

In addition to marketing use described above, Lakeside Services may photograph or video job sites before, during, and after work for insurance, liability, and quality documentation purposes.

20. Good-Faith Communication

Before making a public statement, review, or post about the other regarding the work performed, both parties agree to first attempt the good-faith resolution described above.

21. Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

22. Entire Agreement

This agreement, including the applicable service-specific addendum, represents the entire agreement between the client and Lakeside Services and supersedes any prior verbal or written understanding. Any changes to this agreement must be made in writing and

agreed to by both parties.

23. Insurance

Lakeside Services carries general liability insurance. A current certificate of insurance is attached to this quote for the client's records. Lakeside Services' liability for any claim is limited to the lesser of the amount described in Section 6 (Liability) or the applicable limits of its general liability policy.

24. Subcontractors

Lakeside Services may engage qualified subcontractors to perform all or part of the work described in this quote. Lakeside Services remains responsible for the quality and completion of work performed by any subcontractor.

25. Electronic Signature and Acceptance

This agreement is presented and accepted electronically through Jobber. The client's electronic signature or approval of this quote through Jobber constitutes acceptance of this agreement and any applicable service-specific addendum, with the same effect as a signature on a printed document.

26. Interest and Late Fees

Any balance not paid within 30 days of the invoice date, per the payment terms above, may be subject to a late fee, plus interest accruing monthly on the unpaid balance until paid in full.

27. Client-Supplied Materials

Lakeside Services is not responsible for the quality, performance, or durability of materials supplied by the client rather than sourced by Lakeside Services. Any warranty otherwise available under this agreement does not apply to work involving client-supplied materials.

28. Marking of Underground and Hidden Features

Prior to the start of work, the client is responsible for flagging or otherwise clearly marking the location of any underground lines, sprinkler heads, pet containment wiring, lighting, or other hidden features not readily visible. This is in addition to, and does not replace, the utility locate process described above.

29. Payment Methods

Lakeside Services accepts payment by the methods made available through Jobber. A processing fee of up to 3 percent may apply to card payments, at Lakeside Services' discretion.

30. Site Restoration

Lakeside Services is not responsible for restoring landscaping, lawn areas, or surfaces disturbed by equipment access required to reach the work site, beyond what is included in the scoped work.

Service-Specific Addenda

Attach the relevant addendum below in addition to the Universal Core Clauses, depending on service type.

Addendum A — Hardscape Projects

Retaining Walls. Grading and drainage behind and around the wall are addressed as specified in the quote; Lakeside Services is not responsible for drainage issues outside the scoped work area. Base preparation follows industry-standard practices for the material and application quoted. Minor settling over time is normal and not considered a defect.

Paver Patios. Base preparation follows industry-standard practices for the material and application quoted. Minor material variation in color, size, or shape is normal and not considered a defect. Edging is installed to the specification quoted; shifting due to frost heave or ground movement is not covered.

Addendum B — Landscape, Plant, and Bed Care

Mulch and Rock Installation. Mulch and rock installation is billed per project, with a deposit required as described in the Universal Core Clauses. Mulch and rock are expected to settle, compact, and fade or weather naturally over time, and minor variation in color, size, or shape is normal and not considered a defect.

Plant Installation. Lakeside Services does not provide a warranty on plant material. Ongoing plant health depends on proper watering and care after installation, which is the client's responsibility unless a maintenance package is purchased separately. Lakeside Services is not responsible for plant loss due to inadequate watering, improper care, extreme weather, or conditions outside our control. Planting outside the recommended seasonal window is done at the client's request and risk.

Bed Maintenance. Bed maintenance, including bed upkeep, trimming of bushes and trees, and weeding, is offered as a recurring subscription service billed throughout the year.

Spring and Fall Cleanups. Spring and fall cleanups are billed separately from the bed maintenance subscription and are quoted based on the scope of work.

Addendum C — Snow and Ice Management

Term of Agreement. This agreement covers the season dates identified in the quote. Service begins on the start date listed and ends automatically at season's end unless renewed in writing.

Basis of Pricing. Snow and ice management is quoted on a flat seasonal basis, as identified in the quote. The seasonal rate is priced on the season as a whole and does not vary with the number of service events, except where the quote states a seasonal limit on snowfall totals or number of events. Where such a limit is stated, services performed beyond that limit are billed at the rates shown in the quote. Any services identified in the quote as billed separately, including ice melt applications, are billed as performed in addition to the seasonal rate.

Scope of Service. Lakeside Services will clear the parking areas, drive lanes, walkways, and building entryways identified in this quote. Walkways and entryways are serviced once snowfall accumulation reaches 1 inch. Parking areas and drive lanes are plowed once accumulation reaches 2 inches. Service is provided every day of the week throughout the term, including weekends and holidays.

Ice and Snow Melt Applications. Ice melt is applied to walkways, entryways, parking areas and designated high-traffic areas when winter weather conditions create a slip hazard on treated surfaces, as determined by Lakeside Services. An application is defined as a single treatment of the areas identified in the quote. Whether applications are included in the seasonal rate or billed separately, and any limit on the number included, is as stated in the quote. The client may request additional applications at any time.

Service Timing. Crews will make a reasonable effort to complete clearing by the target time identified in the quote. Target clearing times are a goal rather than a guarantee and depend on storm timing, duration and severity. During active or ongoing storms, service may be performed in multiple passes, and full clearing may not be possible until snowfall ends. Lakeside Services does not guarantee continuously bare pavement at any time.

Exclusions. The following are not included in the quoted seasonal rate and are billed separately at the rates shown in the quote: snow relocation or stacking, off-site hauling, and ice melt applications. Lakeside Services is not responsible for clearing areas obstructed by parked vehicles, dumpsters, or stored materials at the time of service.

Payment Terms. The seasonal total is billed in equal monthly installments as stated in the quote. Services billed separately, including ice melt applications and any services performed beyond a stated seasonal limit, are invoiced monthly for the work performed during that month. Payment is due within 15 days of invoice. Balances past due more than 30 days may result in suspension of service, and suspension does not relieve the client of amounts owed under this agreement.

Cancellation. Either party may cancel this agreement at any time with written notice. Because the seasonal rate is priced on the season as a whole rather than on individual service events, the full seasonal amount is earned upon acceptance and remains due in the event of cancellation, and all remaining installments become immediately due and payable upon cancellation. All separately billed services performed through the cancellation date also remain due.

Property Condition and Client Responsibility. The client agrees to identify and mark in advance any curbs, islands, drains, irrigation heads, sprinkler lines, or other obstructions that may be concealed by snow. Lakeside Services is not liable for damage to unmarked items. The client is responsible for keeping designated snow storage areas accessible and for notifying us promptly of any change to the property that affects service.

Liability and Indemnification. Lakeside Services carries general liability insurance, and a current certificate is attached. Snow and ice conditions are inherently hazardous and can redevelop at any time, including immediately following service. Lakeside Services does not warrant that the property will be free of ice or slip hazards at any time, and is not liable for slip, trip, or fall incidents occurring on the property. The client agrees to indemnify, defend, and hold harmless Lakeside Services from any claims, damages, or costs arising from slip, trip, or fall incidents, except those caused by our gross negligence or willful misconduct. Our total liability under this agreement is limited to the amount paid by the client.

Force Majeure. Lakeside Services is not liable for delays or failure to perform caused by conditions beyond reasonable control, including extreme weather, equipment failure, road closures, or municipal restrictions.

Acceptance. Approval of this quote constitutes acceptance of these terms.

Addendum D — Mowing and Routine Maintenance

Term of Agreement. The mowing season runs from approximately April through October, weather and growth permitting. Service ends automatically at the close of the season; leaf cleanup or other additional services after the final mow are quoted separately.

Frequency. Mowing is performed on a weekly cycle throughout the season.

Basis of Pricing. Mowing is billed per visit rather than a flat seasonal rate.

Weather. Lakeside Services may mow during light rain. Service may be rescheduled at Lakeside Services' discretion during heavy rain, lightning, or unsafe ground conditions, consistent with the weather-related delays described above.

Site Access. The client is responsible for providing reasonable access to the property on the scheduled service day. If a gate is locked or an area is otherwise inaccessible, Lakeside Services will attempt to contact the client by text message, followed by a phone call if there is no response within 5 minutes. If no contact is made, the inaccessible area will not be serviced and will be billed as scheduled.

Billing. Each visit is billed upon completion of that visit's service.

Damage to Unmarked or Hidden Items. Lakeside Services is not responsible for damage to unmarked or hidden lawn items, including sprinkler heads, pet containment wiring, low-voltage lighting, or decorative edging not clearly visible or flagged prior to service.

Debris. Excessive pet waste or yard debris may result in the mow being skipped or an additional cleanup charge.

Addendum E — Window Cleaning

Scope of Service. Window cleaning covers accessible exterior and, where quoted, interior glass surfaces and screens identified in the quote. Lakeside Services is not responsible for pre-existing scratches, seal failures, cracked glass, or damaged screens present before service begins.

Access and Safety. The client is responsible for providing reasonable access to all windows to be serviced, including unlocking or opening windows and clearing nearby obstructions. Lakeside Services will not access windows where doing so would require unsafe conditions, including but not limited to unstable footing, inaccessible upper stories without proper equipment, or obstructed pathways, and such windows may be excluded from service.

Weather. Window cleaning may be rescheduled at Lakeside Services' discretion due to rain, high wind, or freezing conditions, consistent with the weather-related delays described above.

Results. Hard water staining, mineral deposits, and etching are not always fully removable through standard cleaning and may require a separate quoted treatment. Lakeside Services does not guarantee spot-free results under all lighting and weather conditions.

Liability. Lakeside Services' liability for any damage arising from window cleaning services, including glass breakage, is subject to the liability limitation described in Section 6 (Liability) of the Universal Core Clauses.

Addendum F — Junk Removal

Scope of Service. Junk removal covers the items identified in the quote. Additional items identified on-site that were not part of the original quote will be priced separately and require approval before removal.

Basis of Pricing. Junk removal is priced by volume or load, as reflected in the quote. Final pricing may be adjusted if the actual volume or load differs materially from what was quoted.

Prohibited Items. Lakeside Services does not accept hazardous materials, including but not limited to chemicals, paints, fuel, asbestos, or biohazard waste. The client is responsible for disclosing the presence of any such materials prior to service.

Access. The client is responsible for ensuring items are accessible for removal on the scheduled service day. Additional charges may apply for items requiring disassembly or located in areas with limited access.

Disposal. Removed items may be disposed of, donated, or recycled at Lakeside Services' discretion. Lakeside Services is not responsible for retrieving items once removed from the property.

Addendum G — Pressure Washing

Scope of Service. Pressure washing covers the surfaces identified in the quote, which may include driveways, sidewalks, patios, decks, fences, siding, and other exterior surfaces. Lakeside Services selects the appropriate method for each surface, including high-pressure washing or low-pressure soft washing with cleaning solutions.

Pre-Existing Conditions. Lakeside Services is not responsible for pre-existing damage or conditions that pressure washing may reveal or worsen, including but not limited to loose or failing paint, stain, or sealant; cracked, spalled, or deteriorated concrete; loose mortar or siding; rotted wood; and failed window or door seals.

Water Access. The client is responsible for providing access to a working exterior water source on the scheduled service day. If water is unavailable, service may be rescheduled and a trip charge may apply.

Client Preparation. Before service, the client is responsible for closing all windows and doors, removing vehicles, furniture, décor, and other movable items from the work area, and securing pets. Lakeside Services is not responsible for water intrusion through open, unsealed, or damaged windows, doors, vents, or exterior outlets.

Plants and Surroundings. Lakeside Services will take reasonable care to rinse or protect nearby plants and surfaces. Lakeside Services is not responsible for minor plant discoloration, runoff, or overspray onto adjacent surfaces, vehicles, or property.

Results. Oil, rust, paint, tire marks, efflorescence, and deep-set or long-term staining are not always fully removable through standard pressure washing and may require a separate quoted treatment. Cleaning may reveal variation in color between previously stained and unstained areas, which is normal and not considered a defect.

Weather. Pressure washing may be rescheduled at Lakeside Services' discretion due to rain, high wind, or freezing temperatures, consistent with the weather-related delays described above.

Liability. Lakeside Services' liability for any damage arising from pressure washing services is subject to the liability limitation described in Section 6 (Liability) of the Universal Core Clauses.
